Some commenters have questioned the use of the term "not-certified." The final rule makes use of this phrase to avoid any implication that the CDL holder is not medically qualified. This phrase clarifies that the driver's privileges to drive are not being revoked due to FMCSA's negative actions. The final rule also requires the State-designated licensing authority (SDLA) to publish the medical certification status on a CDL holder's CDLIS driver record. This will help prevent false and misleading claims that drivers are medically qualified when, in reality, the driver isn't. The SDLA will be required to provide contact information for the ME who conducted the medical examination on the driver's record, to further prevent fraud. This requirement will remain in place until FMCSA releases new rules to deal with this issue. In the meantime, motor companies can continue to maintain the original or a copy the medical examiner's report in their driver qualifications files as evidence that a driver is medically qualified provided that the carrier can prove the date of receipt of the certificate from the ME.
